Sir Richard Branson wins rights to .xxx domain name

The Virgin Group founder Sir Richard Branson won his Uniform Domain Name Dispute Resolution Policy (UDRP) complaint after getting the backing of the World Intellectual Property Organisation (WIPO).

It was ruled by the WIPO that Sir Richard should have the rights to the address because the cybersquatter, by his own admission, only purchased it as a ‘souvenir’.

Sean Truman, a 23-year-old Australian, was ruled not to have any rights for richardbranson.xxx with the domain name now being transferred to Virgin.

Mr Truman did however claim that Sir Richard had ‘ample opportunity to register the name if he believed that his rights may be under threat by another person’. On December 10, just four days after the .xxx domains were released, Sean Truman picked up and registered ‘richardbranson.xxxfor a few dollars.

Having established all three elements required under the ICANN Policy, the Panel concludes that the <richardbranson.xxx> domain name should be TRANSFERRED TO COMPLAINANT subject to the .XXX sTLD’s Sponsored Community eligibility criteria requirements and the general registration requirements of domain names in the .XXX sTLD.

Given that Virgin is not a porn company, the domain name is set to become a non-resolver which will mean that it won’t work when entered into address bars.

This is the second such case that has occurred since .xxx domain names went on sale in 2011. heb.xxx was transferred to a Texan grocery chain while other domains which have been disputed include foxstudios.xxx and kayjewelers.xxx, according to The Register. The website claims there have been 13 such cases filed since December 29 last year.
